Introduction<\/b><\/h2><p><span style=\"font-weight: 400;\">BVAS.Pro, LLC (\u201cBVAS,\u201d \u201cCompany,\u201d \u201cwe,\u201d \u201cour,\u201d or \u201cus\u201d) provides a fully managed real estate operating system supported by bilingual real estate\u2013trained operators, including CRM deployment, IDX website configuration, integrated VoIP communication systems, automation workflows, marketing infrastructure, and cloud document management (collectively, the \u201cServices\u201d).<\/span><\/p><p><span style=\"font-weight: 400;\">We are committed to protecting the privacy, security, and integrity of client data while operating within applicable federal, state, MLS, telecommunications, and data protection regulations.<\/span><\/p><p><span style=\"font-weight: 400;\">This Privacy Policy explains how we collect, use, store, process, and safeguard information in connection with our Services.<\/span><\/p><h2><b>2. Information Provided by Clients<\/b><\/h3><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Name, brokerage, license information<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">MLS IDs (where voluntarily provided)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Contact information<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">CRM contact lists (client-provided)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Transaction-related administrative data<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Campaign approval confirmations<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Platform configuration preferences<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">BVAS does NOT request or store MLS login credentials.<\/span><\/p><h3><b>B. Contact List Data (Client-Owned)<\/b><\/h3><p><span style=\"font-weight: 400;\">Clients may provide contact lists from:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Existing CRMs<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Google Contacts<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Outlook<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">CSV uploads<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Other supported systems<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">All contact data remains the property of the client.<\/span><\/p><p><span style=\"font-weight: 400;\">BVAS acts solely as a data processor and administrative operator under client authorization.<\/span><\/p><h3><b>C. Communication Data<\/b><\/h3><p><span style=\"font-weight: 400;\">When using integrated VoIP and CRM systems:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Call logs<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">SMS logs<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Campaign delivery records<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Communication timestamps<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">All regulated communications are initiated, logged, and stored within the CRM platform (e.g., Lofty) under the client\u2019s account.<\/span><\/p><p><span style=\"font-weight: 400;\">BVAS does not independently originate communications outside client-authorized systems.<\/span><\/p><h3><b>D. CRM, IDX &amp; Technology Infrastructure<\/b><\/h2><p><span style=\"font-weight: 400;\">BVAS deploys and manages technology platforms on behalf of clients, including but not limited to:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">CRM systems (primarily Lofty)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">IDX websites<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Integrated VoIP communication systems<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Marketing automation systems<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cloud document management systems<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">All CRM and IDX accounts are owned and controlled by the client.<\/span><\/p><p><span style=\"font-weight: 400;\">BVAS operates as an authorized administrative user under client direction.<\/span><\/p><h2><b>6. MLS &amp; Assistant-Level Access<\/b><\/h2><p><span style=\"font-weight: 400;\">Where permitted by MLS providers (e.g., Bright MLS or other regional MLS systems):<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">BVAS personnel may obtain Assistant or Personal Assistant level access.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Access is granted only through MLS-approved processes.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sponsorship and authorization remain subject to broker approval.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">BVAS operates strictly within permitted MLS role limitations.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">BVAS does not access MLS systems without proper authorization.<\/span><\/p><h2><b>7. Telecommunications &amp; Consent Compliance<\/b><\/h2><p><span style=\"font-weight: 400;\">All regulated voice and text communications:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Are initiated within supported CRM platforms<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Are logged within the client\u2019s account<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Follow consent status maintained inside the CRM system<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Clients retain full control over:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Recipient lists<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Consent management<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Campaign approval<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Opt-in\/opt-out status<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">BVAS assists in campaign creation but does not independently authorize campaign distribution.<\/span><\/p><h2><b>8. Data Storage &amp; Security<\/b><\/h2><p><span style=\"font-weight: 400;\">Client-related data may be stored in:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">CRM platform databases<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Secure cloud storage (Google Workspace or Microsoft 365 environments)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Platform-specific infrastructure providers<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">BVAS implements:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Role-based access control<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Administrative segmentation<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Data separation between clients<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Firewall separation protocols between brokerage clients<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Quarterly access review procedures<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Clients retain ownership of all data.<\/span><\/p><p><span style=\"font-weight: 400;\">Upon termination of services, data will be transferred to the client in a commercially reasonable format.<\/span><\/p><h2><b>9. Data Separation &amp; Confidentiality<\/b><\/h2><p><span style=\"font-weight: 400;\">BVAS serves multiple brokerages and agents.<\/span><\/p><p><span style=\"font-weight: 400;\">Strict internal controls ensure:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">No cross-client data sharing<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">No brokerage-to-brokerage data exposure<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Segmented access permissions<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Independent CRM environments per client<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Employees and contractors are bound by confidentiality obligations.<\/span><\/p><h2><b>10. Service Availability &amp; Liability Limitation<\/b><\/h2><p><span style=\"font-weight: 400;\">BVAS provides services on a commercially reasonable basis.<\/span><\/p><p><span style=\"font-weight: 400;\">In the event of a service interruption exceeding 24 consecutive hours and directly attributable to BVAS:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The client\u2019s exclusive remedy shall be service credits proportionate to the affected service period.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Credits apply to future service invoices.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cash refunds are not provided for services already rendered.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Total aggregate liability shall not exceed the equivalent of one (1) month of service fees paid by the client.<\/span><\/p><p><span style=\"font-weight: 400;\">This limitation does not apply where prohibited by law.<\/span><\/p><h2><b>11. Third-Party Platforms<\/b><\/h2><p><span style=\"font-weight: 400;\">BVAS integrates with third-party systems including but not limited to:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Lofty CRM<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">MLS providers<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">VoIP carriers<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Google Workspace<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Microsoft 365<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Use of such platforms remains subject to their respective terms and privacy policies.<\/span><\/p><p><span style=\"font-weight: 400;\">BVAS is not responsible for independent actions of third-party providers.<\/span><\/p><h2><b>12. Data Retention<\/b><\/h2><p><span style=\"font-weight: 400;\">Data is retained:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">During active service engagement<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">As required by law<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">As required by MLS or brokerage compliance rules<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Clients may request data export upon termination.<\/span><\/p><h2><b>13. Children\u2019s Privacy<\/b><\/h2><p><span style=\"font-weight: 400;\">Services are not directed to individuals under 18 years of age.<\/span><\/p><h2><b>14. Governing Law<\/b><\/h2><p><span style=\"font-weight: 400;\">This Privacy Policy is governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.<\/span><\/p><h2><b>15.
