1. Introduction

BVAS.Pro, LLC (“BVAS,” “Company,” “we,” “our,” or “us”) provides a fully managed real estate operating system supported by bilingual real estate–trained operators, including CRM deployment, IDX website configuration, integrated VoIP communication systems, automation workflows, marketing infrastructure, and cloud document management (collectively, the “Services”).

We are committed to protecting the privacy, security, and integrity of client data while operating within applicable federal, state, MLS, telecommunications, and data protection regulations.

This Privacy Policy explains how we collect, use, store, process, and safeguard information in connection with our Services.

2. Scope of Policy

This Privacy Policy applies to:

  • Website visitors (bvas.pro)
  • Prospective clients
  • Active clients (Agents, Teams, Brokers)
  • Contacts uploaded or managed within client CRM systems
  • Communications conducted within supported platforms
  • MLS assistant-level access where authorized
  • Cloud-based document storage environments managed by BVAS

This policy does not override or replace:

  • MLS-specific rules
  • Brokerage compliance policies
  • CRM platform provider privacy terms (e.g., Lofty)
  • Telecommunications carrier compliance rules

Clients remain responsible for their independent compliance obligations.

3. Information We Collect

A. Information Provided by Clients

  • Name, brokerage, license information
  • MLS IDs (where voluntarily provided)
  • Contact information
  • CRM contact lists (client-provided)
  • Transaction-related administrative data
  • Campaign approval confirmations
  • Platform configuration preferences

BVAS does NOT request or store MLS login credentials.

B. Contact List Data (Client-Owned)

Clients may provide contact lists from:

  • Existing CRMs
  • Google Contacts
  • Outlook
  • CSV uploads
  • Other supported systems

All contact data remains the property of the client.

BVAS acts solely as a data processor and administrative operator under client authorization.

C. Communication Data

When using integrated VoIP and CRM systems:

  • Call logs
  • SMS logs
  • Campaign delivery records
  • Communication timestamps

All regulated communications are initiated, logged, and stored within the CRM platform (e.g., Lofty) under the client’s account.

BVAS does not independently originate communications outside client-authorized systems.

D. Website Data

We may collect:

  • IP address
  • Browser type
  • Device information
  • Analytics data
  • Cookies for site functionality

This information is used for site performance and marketing optimization only.

4. How We Use Information

We use collected information to:

  • Deploy and configure CRM and IDX environments
  • Structure automation workflows
  • Set up integrated VoIP systems
  • Manage cloud document environments
  • Provide bilingual administrative services
  • Execute client-approved marketing campaigns
  • Maintain service quality and security
  • Comply with regulatory obligations

BVAS does not sell client data.

5. CRM, IDX & Technology Infrastructure

BVAS deploys and manages technology platforms on behalf of clients, including but not limited to:

  • CRM systems (primarily Lofty)
  • IDX websites
  • Integrated VoIP communication systems
  • Marketing automation systems
  • Cloud document management systems

All CRM and IDX accounts are owned and controlled by the client.

BVAS operates as an authorized administrative user under client direction.

6. MLS & Assistant-Level Access

Where permitted by MLS providers (e.g., Bright MLS or other regional MLS systems):

  • BVAS personnel may obtain Assistant or Personal Assistant level access.
  • Access is granted only through MLS-approved processes.
  • Sponsorship and authorization remain subject to broker approval.
  • BVAS operates strictly within permitted MLS role limitations.

BVAS does not access MLS systems without proper authorization.

7. Telecommunications & Consent Compliance

All regulated voice and text communications:

  • Are initiated within supported CRM platforms
  • Are logged within the client’s account
  • Follow consent status maintained inside the CRM system

Clients retain full control over:

  • Recipient lists
  • Consent management
  • Campaign approval
  • Opt-in/opt-out status

BVAS assists in campaign creation but does not independently authorize campaign distribution.

8. Data Storage & Security

Client-related data may be stored in:

  • CRM platform databases
  • Secure cloud storage (Google Workspace or Microsoft 365 environments)
  • Platform-specific infrastructure providers

BVAS implements:

  • Role-based access control
  • Administrative segmentation
  • Data separation between clients
  • Firewall separation protocols between brokerage clients
  • Quarterly access review procedures

Clients retain ownership of all data.

Upon termination of services, data will be transferred to the client in a commercially reasonable format.

9. Data Separation & Confidentiality

BVAS serves multiple brokerages and agents.

Strict internal controls ensure:

  • No cross-client data sharing
  • No brokerage-to-brokerage data exposure
  • Segmented access permissions
  • Independent CRM environments per client

Employees and contractors are bound by confidentiality obligations.

10. Service Availability & Liability Limitation

BVAS provides services on a commercially reasonable basis.

In the event of a service interruption exceeding 24 consecutive hours and directly attributable to BVAS:

  • The client’s exclusive remedy shall be service credits proportionate to the affected service period.
  • Credits apply to future service invoices.
  • Cash refunds are not provided for services already rendered.

Total aggregate liability shall not exceed the equivalent of one (1) month of service fees paid by the client.

This limitation does not apply where prohibited by law.

11. Third-Party Platforms

BVAS integrates with third-party systems including but not limited to:

  • Lofty CRM
  • MLS providers
  • VoIP carriers
  • Google Workspace
  • Microsoft 365

Use of such platforms remains subject to their respective terms and privacy policies.

BVAS is not responsible for independent actions of third-party providers.

12. Data Retention

Data is retained:

  • During active service engagement
  • As required by law
  • As required by MLS or brokerage compliance rules

Clients may request data export upon termination.

13. Children’s Privacy

Services are not directed to individuals under 18 years of age.

14. Governing Law

This Privacy Policy is governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

15. Policy Updates

BVAS reserves the right to update this Privacy Policy at any time.

Updated versions will be posted with a revised version number.
